New PA Court Rule Allows Citing of Unpublished Opinions
The PA Supreme Court has adopted a new rule, effective May 1, 2019 that allows parties to cite unpublished opinions in the intermediate appellate courts for persuasive authority.
The provision to Rule 126 allows parties to rely on unpublished non-precedential memorandum decisions of the Superior Court filed after May 1, 2019, or an unreported opinion of the Commonwealth Court filed after January 15, 2008.
The change aims to bring greater transparency and consistent treatment of litigants to the appellate courts.
